    1. Acceptance of Terms

    By accessing or using the MerjUp website (merjup.buildwithxela.com) and any associated services, mobile applications, or games (collectively, the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

    2. Description of Service

    MerjUp is a physics-based can-merging puzzle game available on mobile devices. The website provides information about the game, allows users to join a waitlist for early access, and may offer downloads of pre-release versions.

    We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

    3. Waitlist and Communications

    By joining the waitlist, you consent to receive emails from us regarding the Service, including launch announcements, updates, and promotional content. You may unsubscribe at any time via the link provided in our emails.

    4. User Accounts

    When the game launches, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when creating an account.

    5. Intellectual Property

    All content, trademarks, logos, graphics, game mechanics, and code associated with MerjUp are the exclusive property of MerjUp and its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

    6. User Conduct

    You agree not to:

    • Use the Service for any unlawful purpose or in violation of any applicable laws.
    • Attempt to gain unauthorized access to any part of the Service, including other users' accounts or our servers.
    • Interfere with or disrupt the Service, its servers, or networks.
    • Reverse engineer, decompile, or extract the source code of the game or website.
    • Use automated means (bots, scrapers) to access or extract data from the Service without permission.

    7. In-Game Virtual Items

    The game may include virtual currency (coins) and virtual items. These have no real-world monetary value, cannot be exchanged for real currency, and are non-transferable. We reserve the right to modify, revoke, or manage virtual items at our discretion.

    8. Limitation of Liability

    To the fullest extent permitted by law, MerjUp and its owners, developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

    The Service may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party sites.
